On May 6, 2020, the U.S. Department of Education issued new regulations under Title IX of the Education Amendments of 1972, which prohibits discrimination on the basis of sex in education programs or activities receiving federal financial assistance. Similar to all educational institutions receiving federal funding, Rowan was required to amend its current policies to implement these new regulations. As a result, updates to Rowan’s policies related to sexual misconduct were made consistent with these regulations, as well as other applicable laws, including the Clery Act and the Violence Against Women Reauthorization Act of 2013. Specifically, the following policies are effective immediately:

  • Title IX Sexual Harassment/Sexual Assault – this policy applies to both students and employees. It addresses allegations of sexual misconduct that fall within the U.S. Department of Education’s Title IX regulations. The policy’s jurisdiction is limited in scope to Title IX Sexual Harassment/Sexual Assault (as defined in the policy) that meets the following requirements: (1) occurs within the United States, (ii) occurs within the University’s education program or activity; and (iii) at the time of the filing of a formal complaint, the Complainant was participating in, or attempting to participate in, the education program or activity.
  • Student Sexual Misconduct and Harassment Policy – this policy applies only to students. It addresses allegations of sexual misconduct that do not fall within the definitional or jurisdictional requirements of the Title IX regulations. For example, it will apply to allegations of sexual exploitation; or sexual harassment/sexual assault that does not occur on campus or in an education program or activity.

Complaints of sexual misconduct against employees that are not covered by the Title IX Sexual Harassment/Sexual Assault Policy, will be addressed under the Policy Prohibiting Discrimination in the Workplace and Educational Environment

Rowan University is committed to providing an inclusive and welcoming educational and working environment free of all forms of sexual misconduct. It is important to know that all conduct of a sexual nature that previously constituted a violation of University policy will continue to constitute a violation of University policy; however, such conduct may now be adjudicated under different grievance procedures. We urge Rowan’s community members to review the full text of the policies.

The Office of Student Equity and Compliance (OSEC) provides information regarding our policies and procedures related to sexual misconduct and other onsite and offsite supprt services and resources. An individual is encouraged to consult with the University AVP/Title IX Coordinator to report any concerns.

In addition, confidential resources are available to assist in accessing counseling and support services.

Training as mandated by OCR:

In response to 34 CFR Part 106.45(b)(10) of the 2020 Title IX Regulations that mandates the public sharing of materials used to train school and college Title IX team members, Rowan has created a Title IX Schedule of Training containing links to training materials. This document will be updated on a regular basis upon training completion as materials become available.

The Division of Diversity, Equity and Inclusion, Office of Student Equity & Compliance (OSEC) is located in Savitz Hall, Rm 203. The office plays a significant role in providing students support and protection under Title VI and Title IX.

Title VI

Title VI of the Civil Rights Act of 1964 prohibits discrimination on the basis of race, color, or national origin in any program or activity receiving Federal financial assistance. The University addresses allegations of Title VI violations under the Policy Prohibiting Discrimination in the Workplace and Educational Environment.

Title IX

Contrary to popular belief, Title IX does not protect only athletes in higher education.  It also protects any and all students who feel they have been harassed or discriminated against due to their sex/gender. It is important to talk to someone if you believe you witnessed sex discrimination or sexual misconduct. Witnesses are also protected by Title IX and have the right to file a complaint and report the incident.

Title IX states:

"No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance."

Student Sexual Misconduct and Harassment

Rowan University takes all allegations of sexual misconduct very seriously. To address allegations that do not fall within the definitional or jurisdictional requirements of the Title IX regulations, the University uses a second policy, the Student Sexual Misconduct and Harassment Policy. This policy, for example, applies to allegations of sexual exploitation; or sexual harassment/sexual assault that does not occur on campus or in an education program or activity
